وبعد تلاوة أمر الإحالة وسماع طلبات النيابة والمرافعة ومطالعة الأوراق والمداولة قانونا
وبجلسة اليوم سمعت الدعوى على الوجه المبين تفصيلا بمحضر الجلسة

بعد تلاوة أمر الإحالة وسماع طلبات النيابة العامة ومطالعة الأوراق والمداولة حيث إن المتهمين لم يحضرا بجلسة المحاكمة رغم اعلانهما ومن ثم تقضى المحكمة في غيبتهما عملا بنص المادة304 / 2 من قانون الإجراءات الجنائية ومعاقبتهما بالمواد 230 و 231 و232 من قانون العقوبات والمواد 1/2 و6 و26/52 من القانون 394 /1954المعدل بالقانون 26 / 1978 و101 لسنة 1980 و165 لسنة 1981 والبند رقم (ب )من القسم الثاني من الجدول رقم 3الملحق بالقانون الأول والمعدل بقرار وزير الداخلية رقم 13354 لسنة 1995 وحيث انه وعن التهم المسندة إلى المتهمين فقد وقعت لغرض اجرامى واحد وارتبطت ببعضها ارتباطا لا يقبل التجزئة ومن ثم يتعين عملا بالمادة 32/2 من قانون العقوبات اعتبارها جريمة واحدة والحكم بالعقوبة المقررة لأشدهم وهى عقوبة الجريمة الأولى
وحيث انه نظرا لظروف الدعوى وملابساتها ترى المحكمة أخذ المتهمين بقسط من الرأفة في حدود ما تسمح به المادة 17 من قانون العقوبات وتنزل بالعقوبة للحد الوارد بالمنطوق وحيث انه وعن المصاريف الجنائية فالمحكمة تلزم بها المتهمين وقد قضى بإدانتهما على سند من حكم المادة 313 من قانون الإجراءات الجنائية
فـلهــــذه الأسبـــــاب
وبعد الإطلاع على المواد سالفة الذكر حكمت المحكمة غيابيا بمعاقبة رفاعي محمد على السيد وشهرته بدوى والسيد محمد على السيد بالسجن المؤبد عما نسب اليهما وألزمتهما المصروفات الجنائية
صدر هذا الحكم وتلي علنا بجلسة الأحد 17 شوال 1431 هجرية الموافق 26/9/2010م

After reading the committal order and hear requests for public prosecutors and view the papers and the debate as the defendants did not attend the hearing the trial despite their declaration, then the court shall in Gepthma pursuant to the provisions of Article 304 / 2 of the Code of Criminal Procedure and punishing them, articles 230 and 231 and 232 of the Penal Code and Articles 1 / 2, 6, 26 / 52 of Law 394/1954 as amended by Law 26/1978 and 101 for the year 1980 and 165 for the year 1981 and Item No. (b) of Section II of Schedule No. 3 to the Act I, as amended by the Minister of Interior No. 13 354 for the year 1995 and where he and the charges against the defendants had signed for the purpose of criminal one are inextricably linked and indivisible and therefore must be pursuant to Article 32 / 2 of the Penal Code be considered a crime and one sentence assessed a penalty for the most first crime

Having considered the above-mentioned articles the court ruled in absentia to punish Mr. Rifai Mohamed Badawi and his fame, Mr. Mohamed Ali Mr. sentenced to life imprisonment for allegedly Olzimthma them and criminal charges
